Frequently asked questions

How long do I have to challenge a dismissal?

The deadline is 20 working days from the date of dismissal, not counting weekends or public holidays. It is a strict time-bar: if you let it expire, you lose the right to challenge. So if you think your dismissal is not correct, seek advice as soon as possible. We study your case right away and, if appropriate, prepare the conciliation claim (papeleta de conciliación) within the deadline.

I work without a contract: do I have rights?

Yes. Even if there is no written signed contract, the employment relationship still exists and the law protects you. You have the right to be paid your wages, to be registered with Social Security and to make a claim if you are dismissed. The important thing is being able to prove you were working: messages, transfers, witnesses or a set schedule. Tell us your situation and we will look at what evidence you have and what you can claim.

Can I be dismissed while on sick leave?

You can be given a dismissal notice while on sick leave, but that dismissal can be challenged. Depending on the reason, it could be declared unfair or even null if it is shown that you are being dismissed because of the sick leave, which can mean reinstatement. Each case depends on its circumstances and the evidence. If you are dismissed during sick leave, we review your case and explain what options you have to make a claim.

What is FOGASA?

FOGASA (the Wage Guarantee Fund) is a public body that pays outstanding wages and compensation to workers when the company cannot do so because it is insolvent or in insolvency proceedings. It has maximum caps and deadlines to apply. If your company does not pay you and has nothing to pay with, we help you file the application with FOGASA to claim the amounts that may be due to you, within the limits set by law.
